MEDIA AND COMMUNICATION TECHNOLOGY POLICY, RULES AND REGULATIONS ISSUES
TASK 1: MALAYSIAN COMMUNICATIONS AND MULTIMEDIA COMMISSION ACT 1998
INTRODUCTION
In this legal analysis, ARTICLE 19 reviews the Communications and Multimedia Act of Malaysia (the Act) for its compliance international human rights standards, in particular those on the right to freedom of expression.
ARTICLE 19 is concerned that the Act has been invoked frequently in the recent years to restrict active social media usage in Malaysia. It has been used by law enforcement agencies and the Attorney General of Malaysia to arrest, investigate and charge individuals expressing progressive or dissenting views. At present, a constitutional challenge is being mounted against the Act at the Federal Court.
The Act is not the only piece of legislation that is invoked to suppress freedom of expression in Malaysia, in particular online; other laws include the Sedition Act 1948, S114A of the Evidence Act 1950 and the Film Censorship Act 2002. Often, charges are brought jointly under several laws simultaneously. The most prominent cases of prosecutions include:
Case of Khalid Ismath who was arrested under Section 233 of the Act in October 2015 for allegedly posting a comment on Facebook. He was charged with 11 alleged offences under the Act and three more charges under the Sedition Act for the same offences. Khalid was subiect to several bail conditions including a requirement to report to the nearest police station every 2 weeks, a ban on travel outside of the country and his passport was confiscated by the court; 1
Case of Muhammad Amirul who was found guilty of 14 counts of offence under Section 233 of the Act in April 2016 in Kelantan for allegedly insulting a member of the royal family on Facebook. He was initially sentenced to 1 year imprisonment which was later over turned and changed to being sent to a reform school sentence for 2 years; 2
Case of Pa Ya (76-year-old man) who was arrested in June 2016 under the Act for allegedly posting an insulting picture on a Whatsapp group chat;
ARTICLE 19 reviewed the Act as it serves as a 'catch-all' legislation and the legislation that enables the interception of the communication, tracking and ultimately prosecution. The Act has an expansive scope, ranging from spectrum allocation and consumer protection to content regulation and investigatory powers. The main subjects of regulation under the Act are applications services and network services. The Act further pertains to content applications services, which appear to include online intermediaries. The governmental actors involved in the administration of the Act are "the Minister charged with responsibility for communications and media" and the Malaysian Communications and Multimedia Commission, which is established under the Act.
ARTICLE 19 calls on the Malaysian Government to introduce the necessary amendments to the Act and ensure it fully complies with the international freedom of expression standards. We stand ready to provide further assistance in this process.

Sultan Ibrahim Ibni Almarhum Sultan Iskandar Al-Haj (Jawi: سلطان إبراهيم ابن المرحوم سلطان إسكندر; born 22 November 1958) is the 25th Sultan of Johor and the 5th Sultan of modern Johor. He is the son of Sultan Iskandar. A motorcycle enthusiast, Sultan Ibrahim is well known as the founder of the annual motorcycling tour event, Kembara Mahkota Johor.[1]
The Sultan of Johor is a hereditary seat and the sovereign ruler of the Malaysian state of Johor. In the past, the sultan held absolute power over the state and was advised by a bendahara. Currently, the role of bendahara has been taken over by chief minister (Malay: Menteri Besar) with the constitutional monarchy system via Johor State Constitution. The Sultan is the constitutional head of state of Johor. The Sultan has own independent military force Royal Johor Military Force (Malay: Askar Timbalan Setia Negeri Johor). The Sultan is also the Head of Islam in Johor state.[1]
Johor is a constitutional monarchy and was the first state in Malaysia to adopt the system via Undang-undang Tubuh Negeri Johor (the Johor State Constitution) written by Sultan Abu Bakar in 1895.[91][92] The constitutional head of Johor is the Sultan. This hereditary position can only be held by a member of the Johor Royal Family who is descended from Abu Bakar. The current Sultan of Johor is Ibrahim Ismail, who took over the throne on 23 January 2010.[93]
The main royal palace for the Sultan is the Bukit Serene Palace, while the royal palace for the Crown Prince is the Istana Pasir Pelangi; both palaces are located in the state capital. Other palaces are the Grand Palace (which is also located in the state capital), Tanjong Palace in Muar, Sri Lambak in Kluang and Shooting Box in Segamat.[94] The state government is headed by a Menteri Besar, who is assisted by an 11-member executive council (exco) selected from the state assembly members.[95] The legislative branch of Johor's government is the Johor State Legislative Assembly, which is based on the Westminster system. Therefore, the chief minister is appointed based on his or her ability to command the majority of the state assembly. The state assembly makes laws in matters regarding the state. Members of the Assembly are elected by citizens every five years by universal suffrage.[96] There are 56 seats in the assembly. The majority (39 seats) are currently held by Pakatan Harapan (PH) after the 2018 general election.[97]
Tunku Ibrahim Ismail was born on at 22 November 1958, Sultanah Aminah Hospital, Johor Bahru, Johor, Malaya[2] during the reign of his great grandfather, Sultan Ibrahim. He was the eldest son of Sultan Iskandar by his first wife Josephine Ruby Trevorrow (2 December 1935 – 1 June 2018), an English lady from Torquay,[3][4] whom Sultan Iskandar (then Tunku Mahmud) met while he was studying in England.[5][6] Trevorrow, a proprietor by profession, took on the name of "Kalsom binti Abdullah" for a time following her marriage to Tunku Iskandar.[7] His mother has since remarried and lived in England.[8]
A few hours before his father's death on 22 January 2010, Tunku Ibrahim was appointed as the Regent of Johor, following medical reports that suggested of Sultan Iskandar's pending demise.[15] Sultan Iskandar died on the same night, and Tunku Ibrahim was installed as the Sultan of Johor the following morning.[16] The Menteri Besar (Chief Minister) of Johor, Abdul Ghani Othman cited that Sultan Ibrahim and immediate members of the royal family will undertake a mourning period of 40 days.[17] During the mourning season, Sultan Ibrahim made his inaugural presence at the Conference of Rulers in February 2010 as the Sultan of Johor.[18]
He was crowned as the Sultan of Johor on 23 March 2015.[21] The last coronation was that of his grandfather Sultan Ismail on 10 February 1960.[22] From 2015 onwards, 23 March is made an annual state public holiday as the Sultan's official birthday, replacing the public holiday on 22 November, the Sultan's actual birthday.[23]
He is noted for his religious moderation and has condemned the creeping Arabisation of Malaysian Muslim culture.[24] Despite being the only Sultan in Malaysia without tertiary (postsecondary) education, His Majesty is well known for his genuine interests in ensuring quality education of his subjects.
Sultan Ibrahim issued a decree banning vape in Johor effective 1 January 2016. The purposes of the ban is for the sake of the health of the Johor state residents. Kelantan and Terengganu followed soon after.[38]
In January 2016, Sultan Ibrahim also decreed that signboards for businesses must not exceed 6.1 m × 1.2 m, so as to prevent any dangers to the public as well as to reduce unsightly signboards which mar the city beauty.[39]

Against a backdrop of worsening race relations and decreasing religious tolerance, the sultan has applauded the contributions of Johor’s Chinese and Indian minorities, bemoaned his countrymen’s fading fluency in English and condemned the creeping Arabisation of its once moderate Muslim culture, notes Frances Hutchinson of ISEAS, a think-tank. As for the crown prince, when religious types criticised him for daring to shake hands with women last year, he resorted to the protection of an over-sized rubber glove in a parody of exaggerated piety.

I was amazed to read the story of an Australian lady who fell in love with a Sheaffer Targa since 1971 when she was 14 years until now. That was quite a love affair!When I was in primary school(1959-1964), I was using a cheapo Pilot pen from Japan. My late father was then using a Parker pen. Not only that he was also wearing a Rolex watch-a gift from Kelantan Royal Family member. His DNA for branded goods went into my blood. After I graduated from Sheffield U in June 1976, I returned home wearing Clarks shoes until today. Four years ago, I saw my first grandson was wearing a pair of Clarks shoes and checkered shirt like his grandfather. C'est la vie.Before I digress further and get lost in the nostalgia of the yesteryears, let me come back to my experience of using pens over the last four decades of my life. When I became an engineer, my first pen was Parker. I think you know why. I wanted to have a pen as my father had. When I became the CEO of a public listed company, I got carried away with the corporate position and bough a Mont Blac. It was quite a heavy and expensive pen. I used for signing important documents and cheques. After two years, the pen started to bleed. So I went back to use better Pilot pen and ending buying a few. The fashionable one is Capless Pen. It was cool but I seldom use it.My techy friends introduced me to Pelikan-a German pen company back then. I love the German precision instruments but the designs are boring. From Pelikan, I moved to Lamy- another German engineering masterpiece with better design. Now I have four of them and look forward to buying the latest models. People who love pens are similar species to people who love books. I am one of them. We have more books than we can read. Such is life.[ The above is my writing exercise during MCO2.0 in order to improve my creative writing skill and a form of personal documentary. We spent a few days in Kota Bharu on the way to and from the Perhentian islands, and decided to make the most of being in Royal Seat of Kelantan! The city has a few cool museums, mostly about the royal family and Kelantan traditions, and the museums did a great job of explaining the ceremonies, costume and traditions which make Kelantan unique. The highlight definitely had to be Aaron taking part in some traditional drumming at the Cultural Centre...and he managed to keep the beat wooo! We ended the day eating tasty and ridiculously cheap food at the night market...can’t go wrong with blue rice!

Tiara Highlights of 2022
2022 was the year of the tiara debut with three future queens and a bunch of other people wearing their first tiara. All of my highlight picks are first tiaras and this isn't even all of them! You can check out all of the tiaras (or at least the ones I was able to find pictures of) worn during 2022 here.
Princess Fadzilah of Brunei's Wedding
Princess Fadzilah wore two of Queen Saleha's tiaras for her wedding to Abdullah Al-Hashimi in January. Both of them are massive so I'm impressed with how well she wore them for her first time wearing a tiara. Princess Fadzilah wearing the blue and pink diamond toppers but not the diamond heart made me realize that Queen Saleha's Diamond Tiara and Queen Saleha's Diamond Heart Tiara have been the same tiara all along. Also, there was a royal wedding cat who attempted to steal the show.
Tommy Dorfman at the Met Gala
The Met Gala usually provides us with a few tiara sightings and this year had even more because of the 'Gilded Glamour' theme. While many of the attendees wore bigger or more impressive tiaras, even one made specifically for the event, I keep being drawn to Tommy Dorfman wearing a Regency Era, green paste, hair-comb from Fred Leighton. This is the perfect way to wear a tiara to a fashion event. It's simple and stunning and by wearing it backwards but still placed impeccably it provides just that bit of quirkiness to make it stand out. It's different in an interesting way not just for the sake of being different. Special mention should go to Léna Mahfouf who also wore a tiara very well at an event where we saw a lot of bad ones.
Princess Ingrid Alexandra of Norway's First Tiara
The pandemic caused a bit of a backup in newly of age princesses wearing their first tiara so Princess Ingrid Alexandra's postponed 18th birthday celebrations provided not just her but also two other future queens their first opportunity to wear a tiara. The birthday girl wore a pearl and diamond tiara by Boucheron that belonged to her great-great-grandmother and was left to her by her great-aunt. I thought the Norwegian royal family did a great job of emphasizing the historical and emotional connection of Princess Ingrid Alexandra wearing the tiara and of course she looked great in it.
Princess Elisabeth of Belgium's First Tiara
The biggest surprise in Norway was actually from Princess Elisabeth of Belgium, the Duchess of Brabant. She wore a new to the family tiara that is most likely one that was once owned by the Vestey family. The Belgian royals don't have a large jewelry collection and very rarely add new pieces so it was totally unexpected but very welcome.
Princess Catharina Amalia of the Netherlands' First Tiara
Princess Catharina Amalia, the Princess of Orange, choose the Star Button Tiara for her first tiara outing. It was the one worn by her mother, Queen Maxima, on her wedding day so a very sentimental choice that she wore beautifully. Princess Catharina Amalia has spoken more than once about her love of tiaras so I'm very interested to see her explore the large Dutch collection in the future.
Sultanah Nur Diana Petra of Kelantan's First Tiara
This summer Nur Diana was elevated to the rank of Sultanah or Queen of Kelantan and in November we finally saw her in her first tiara. She choose Queen Zainab's Diamond Tiara which features the state emblem of Kelantan. I think she'll wear this one the most in the future but hopefully she wears some of the other tiaras belonging to the Kelantan royal family too.
Le Bal
There are usually tiaras at Le Bal des Débutantes in Paris every year but this year the official jeweler was an antique/estate jeweler with a huge collection of historical items instead of a contemporary jeweler which made the event so much more exciting. Six of the attendees wore a tiara or aigrette for the first time. In the top row are Leah Isadora Behn, Archduchess Sophia of Habsburg-Lorraine, and Wenhao Cai and the bottom row are Bristol Fales Hill, Princess Hélène of Orleans, and Princess Inayatinder Kaur of Patiala.

Merdeka or Independence Day and Malaysia Day - Hari Malaysia should not be mistaken as the same day. They are separate important days in Malaysia. Independence Day is a celebration on the 31st of August and Malaysia Day is celebrated on the 16th of September.
So why do we have 2 days to commemorate these days? This is because Independence Day is celebrated to commemorate the independence of the federation of Malaya from the British colony, whereas Malaysia Day - Hari Malaysia is celebrated to commemorate the joining of the federation of Malaya, North Borneo (Sabah), Sarawak and Singapore to become a new country called Malaysia.

“They should make a soap opera about the Kelantan royals. The former sultan married a young woman who was banned by the official wife to visit her husband & she was divorced 3 years later. The current sultan is a cruel weirdo who married a model as his wife, hiding the fact that he already married another woman and later abandoned the model and their child. Then, made the hidden wife official wife after 12 years of marriage LOL. The worst one has the to be the youngest son Fakhry who married a 16 year old and basically kidnapped her when she wanted out and abused her until she literally escaped when she got chance. Pahang crown prince Tengku Abdullah Sultan Ahmad Shah will be proclaimed as the new state sultan on Jan 15.
This was confirmed in an announcement by Tengku Muda Pahang Tengku Abdul Rahman Sultan Ahmad Shah at the Istana Abu Bakar in Pekan.
Tengku Abdul Rahman said the proposal on the succession was made because of the health of his father, current ruler Sultan Ahmad Shah.
“In this sad situation, regretfully, I and my family have to accept the fact that my father can no longer shoulder the duties and responsibilities as ruler.
“In view of the situation, I and my closest family members agreed to propose to the Pahang Royal Council to appoint my elder brother Tengku Abdullah to be the successor,” he was quoted as saying by Bernama.
Earlier, Malaysiakini reported multiple sources indicating that Tengku Abdullah would be made the new Pahang ruler next week.
Malaysiakini also learned that Pahang Menteri Besar Wan Rosdy Wan Ismail will be pulled away from the Cameron Highlands by-election campaign in the middle of next week.
He is expected in Pekan, the seat of power for the Pahang royal household.
A source within the Pahang government told Malaysiakini that the proclamation ceremony will take place on Jan 15 in the town.
This was also corroborated by a senior civil servant close to the palace.
“My information from the palace is that Tengku Abdullah will be proclaimed as the Pahang Sultan… so it is likely he will become the next Yang di-Pertuan Agong,” said the source.
A third source from Pahang BN, who is also close to the state palace, said he too has been informed that Tengku Abdullah will be proclaimed as the new Pahang sultan, but did not have a timeline.
The talk came a day after Tengku Abdullah chaired a special meeting by the Pahang Royal Council, along with all its royal chieftains. Sultan Ahmad Shah is in line to become the next Agong following the resignation of Kelantan ruler Sultan Muhammad V.
If his health prevents him from taking the throne, then the position will fall to Johor ruler Sultan Ibrahim Sultan Iskandar, who is next in line under the rotational constitutional monarchy system.
Sultan Ahmad Shah abdicating and allowing his son Tengku Abdullah to take his place would allow the latter to then take on the position of Agong. – MalaysiaKini
